In addition to traditional risk assessment and evaluation, K&A established the Claims Management Program®. The Program is intended to minimize all liability-related costs, including attorneys’ fees, settlements and insurance premiums, by resolving resident and third party claims prior to litigation. As part the Program, community managers are trained on handling all liability claims, including mold and other toxic torts. The Program has been highly effective in preventing litigation at large and small properties throughout the nation. Through early investigation and evaluation by legal professionals, the number of claims and any related costs are substantially reduced.
Moreover, the Program effectively reduces the number of liability claims which result in litigation. According to our Clients, the most immediate benefit of the Program is the reduction of time and effort devoted by property owners and managers to handing liability claims. CLAIMS MANAGEMENT
From the onset of a claim for damages, a legal professional conducts a prompt investigation and evaluation of the claim. Upon approval from the client, our office communicates the decision to the claimant. A practical benefit of the Program is the separation of legal issues from marketing of the property, as the investigation and evaluation of claims are not handled by the community manager. Another benefit of the Program is the substantial reduction of time devoted by Management to handling liability claims, without affecting the client's control over the resolution of the claims. Most importantly, the Program reduces the number of claims and mitigates high exposure claims.

VENDOR/THIRD PARTY CONTRACTS
In many cases, properties are sued as a result of alleged misconduct or negligence on the part of vendors. Accordingly, contracts with these parties should include proper indemnification and liability provisions. Our office provides prompt evaluation and recommendations concerning proposed vendor agreements, in an effort to avoid the potential for future misunderstanding or litigation with vendors.
24/7 ACCESS TO LEGAL ADVICE
The Program is designed to provide legal support to community and regional managers, who are on the “front line” of defending properties from unmeritorious claims. Accordingly, a key component of the Program is access to legal advice at any time.
